WAIVER AND RELEASE OF LIABILITY

In consideration of being invited to join The Newcomers Club of Bend, Inc. (“NCOB”) and being permitted to participate in NCOB events, including travel to and from such events if travel is provided by NCOB or its agents (the “Events”) in which I choose to participate, I, for myself, my heirs, executors and administrators, accept the risks inherent in any Event I participate in with the NCOB.

I affirm that I have no health problems or complications that will preclude my participation in the Events.  Further, I agree that personal safety is of the utmost importance and is primarily dependent upon the individual taking proper care of him or herself and, therefore, I agree to make sure that I know how to safely participate in all Events, and agree to observe any and all rules and practices which may be employed to minimize the risk of injury or illness
and agree and warrant that if, at any time, I feel anything to be unsafe that I will immediately advise the appropriate NCOB official(s) of such and will immediately cease participation in said activity.  I assume responsibility for knowing, understanding, and appreciating the inherent risks associated with participating in any specific Event and hereby assume all of the risks, whether known or unknown, and waive any specific notice of the risks.

I hereby waive, release, and forever discharge NCOB, including any director, officer, employee, volunteer, representative, agent, member or affiliate, thereof, and any of their successors or assigns (collectively, the “NCOB and related parties”) from any and all liabilities, claims, demands, expenses, or damages of every kind and nature whatsoever, whether known or unknown, including but not limited to reasonable attorneys’ fees and costs, arising from or in any way related to my membership or attendance at or participation in the Events, whether the result of negligence or any other cause.

Further, I agree to indemnify, defend, and hold harmless the NCOB and related parties from any and all liabilities or claims made by other individuals or entities arising from or in any way related to my membership or attendance at or participation in the Events, including but not limited to reasonable attorneys’ fees and costs.

This Waiver and Release of Liability shall be construed broadly to provide a release and waiver to the fullest extent permitted under applicable law and that if any portion hereof is later found to be invalid or unenforceable, the balance of this Waiver and Release of Liability shall continue in full force and effect.

Participation in NCOB activities is voluntary. Members and their guests assume responsibility for any loss, property damage or injury suffered in connection with participation in any NCOB activity. I understand that my name, picture, image and/or likeness may appear on the NCOB website, social media site, and newsletter.

Clicking the accept button below acts as my signature and indicates that I am at least 18 years old and that I have read this Waiver and Release of Liability and I understand the content and understand that, by signing it, I have given up substantial rights, including the right of financial recovery for injury, whether the injury results from the inherent risks of the Events or from the negligence of NCOB and I sign this Waiver and Release of Liability freely and voluntarily without inducement.
